Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Sherlock mobile application and any related services (collectively, the "App"), operated by Kurdsoft ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

Important. Sherlock is a tool for searching publicly available images on the open internet. It is intended for lawful, personal, and safety-related purposes only. It is not a consumer reporting agency and its results must not be used for any purpose covered by the Fair Credit Reporting Act (FCRA) or any equivalent law, including decisions about credit, employment, housing, insurance, or tenant screening.

1. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into these Terms.

2. What the App Does

Sherlock lets you upload a photo of a face and performs a reverse-image search against publicly accessible sources on the internet using a third-party search provider. The App may return links, thumbnails, and similarity scores for images that the provider considers visually similar. Results are generated by automated systems, may be incomplete or inaccurate, and are provided for informational purposes only. We do not guarantee the identity, accuracy, completeness, or relevance of any result.

3. Acceptable Use

You agree that you will not use the App to:

Stalk, harass, threaten, dox, defame, intimidate, or harm any person;
Violate any person's privacy or any applicable law or regulation;
Make decisions about credit, employment, housing, insurance, education, or tenant screening, or any other use governed by the FCRA or similar laws;
Identify or surveil any individual without a lawful basis;
Upload images you do not have a lawful right to use, or images of minors;
Reverse engineer, scrape, overload, or interfere with the App or its underlying services;
Resell, redistribute, or commercially exploit results without our written permission.

You are solely responsible for how you use the App and for any consequences of that use. You agree to comply with all applicable local, national, and international laws.

4. Credits, Subscriptions, and Payments

Certain features require search credits or a subscription, which may be purchased through your Apple App Store account. Payment will be charged to your Apple ID at confirmation of purchase.

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
You can manage or cancel subscriptions in your device's Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period.
Credits are a limited, revocable license to use App features. They have no cash value, are non-transferable, and are generally non-refundable except where required by law.
Refund requests for App Store purchases are handled by Apple under the Apple Media Services Terms.

5. Intellectual Property

The App, including its design, branding, text, and software, is owned by Kurdsoft and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.

6. Third-Party Services

The App relies on third-party providers, including a reverse-image search provider and payment, analytics, and infrastructure services. Your use of the App may also be subject to those providers' terms. We are not responsible for third-party content or services.

7. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that results are accurate or that the App will be uninterrupted, secure, or error-free.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KURDSOFT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD 50.

9. Indemnification

You agree to indemnify and hold harmless Kurdsoft from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the App or your violation of these Terms or any law or third-party right.

10. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or used the App unlawfully. You may stop using the App at any time.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-laws principles, except where mandatory consumer-protection laws of your country of residence apply.

13. Apple App Store

These Terms are between you and Kurdsoft only, not with Apple. Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
